1. Service Description

Mozart Pay is a payment orchestration platform that enables businesses to integrate multiple payment gateways through a single API. We provide tools to create, manage, and monitor payments across supported providers including Stripe, TrueLayer, Pay360, Fena, and Trust Payments.

2. Account Registration

To use Mozart Pay, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including API keys and gateway credentials stored on the platform. You must notify us immediately if you become aware of any unauthorized use of your account.

You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your business.

3. Acceptable Use

You agree to use Mozart Pay only for lawful purposes and in accordance with these terms. You must not:

• Use the platform to process payments for illegal goods or services
• Attempt to gain unauthorized access to any part of the platform
• Interfere with or disrupt the platform or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the service
• Use the platform in a way that could damage, disable, or impair the service
• Resell or redistribute access to the platform without our written consent

4. API Usage

Access to the Mozart Pay API is governed by rate limits and usage quotas associated with your plan. You must keep your API keys confidential and rotate them if you suspect they have been compromised. We reserve the right to suspend API access if we detect abusive or abnormal usage patterns.

5. Payment Processing

Mozart Pay acts as an orchestration layer between your application and third-party payment gateways. We do not directly process, hold, or settle funds. All payment processing is performed by the underlying gateway providers, and you are subject to their respective terms of service. You are responsible for ensuring your use of each gateway complies with their requirements.

6. Data Handling

We handle your data in accordance with our Privacy Policy. You are responsible for ensuring that your use of the platform complies with all applicable data protection laws, including obtaining necessary consents from your customers.

7. Fees and Billing

Pricing for Mozart Pay is set out on our website or as agreed in your subscription. We may update pricing with reasonable notice. Gateway transaction fees charged by third-party providers are separate from Mozart Pay fees and are your responsibility.

8. Limitation of Liability

To the maximum extent permitted by law, Mozart Pay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from or related to the service shall not exceed the fees you paid to us in the twelve months preceding the claim.

We do not guarantee uninterrupted or error-free operation of the platform. Payment processing depends on third-party gateway availability, which is outside our control.

9. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access if you breach these terms or if we reasonably believe your use poses a risk to the platform or other users. Upon termination, your right to use the service ceases immediately. We may retain your data for a reasonable period as required by law or legitimate business purposes.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
